Our Approach: We resolve disputes through good-faith dialogue first. Legal proceedings are a last resort. Most issues can be resolved quickly with clear communication and our structured escalation process.

ViViDApps is committed to delivering exceptional work and maintaining healthy, long-term client relationships. We recognise that disputes can occasionally arise in any professional engagement. This Policy outlines a clear, structured, and fair process to resolve any disagreements efficiently, transparently, and with minimum disruption to both parties.

3. Dispute Resolution Process

Step 1 — Direct Notification (Days 1–5)

The aggrieved party must submit a written dispute notice to disputes@vividapps.in within 30 days of the event giving rise to the dispute. The notice must include:

ViViDApps will acknowledge the dispute within 24 business hours.

Step 2 — Internal Review (Days 5–15)

Our senior team will conduct a thorough review of the project records, communication logs, deliverables, and timelines. We will provide a written response to the dispute within 10 business days of receipt, including our position and a proposed resolution.

Step 3 — Good-Faith Negotiation (Days 15–30)

If the proposed resolution is unsatisfactory, both parties agree to enter into good-faith negotiation — which may include a video/phone call with senior representatives from both sides — to reach a mutually acceptable resolution. We aim to resolve all disputes within 30 days of the original notice.

Step 4 — Mediation (Days 30–60)

If negotiation fails, either party may refer the matter to an independent mediator. Costs of mediation are shared equally unless otherwise agreed. Mediation shall be conducted in India under applicable Indian arbitration guidelines.

Step 5 — Legal Proceedings

If mediation fails or is refused, either party may pursue legal remedies through the competent courts of India. This is a last resort and both parties agree to attempt all prior steps sincerely before initiating litigation.

4. Work During Dispute

Unless specifically agreed otherwise, work on the disputed project may be paused during the dispute period. ViViDApps is not liable for delays resulting from a project pause initiated in good faith due to an active, documented dispute.

Important: Clients must not initiate chargebacks or payment reversals through banks/card providers without first completing Steps 1–3 of this process. Chargebacks initiated without following this policy may be contested legally.

5. Time Limits

Disputes must be raised within 30 calendar days of the event giving rise to the dispute. Disputes raised after this period may not be considered unless exceptional circumstances are demonstrated in writing.

6. Governing Law

This Disputes Policy is governed by the laws of India. Any legal proceedings arising out of unresolved disputes shall be subject to the exclusive jurisdiction of the competent courts in India.
